§ 45-706. Loudspeakers, public address systems, etc.

  • (a)

    Definitions. For the purposes of this section, the following words and phrases shall have the meanings given to them by this subsection:

    (1)

    Emergency purposes. Use during tornado, riot, fire, natural catastrophe, or threat thereof and for regular police and fire department practices.

    (2)

    Operation within the city. Includes operation of a public address system, whether it be stationary or portable, within the corporate limits of the city or within one-half (½) mile thereof.

    (3)

    Permission. A permit applied for and granted as set forth in section 37-16 of this Code.

    (4)

    Public address systems. Any loudspeaker, public speaking device, or other mechanical or electrical device used for the magnifying of the human voice or phonograph or electronic recordings for advertising or attention getting purposes.

    (b)

    Prohibition.

    (1)

    No person shall for any purpose or at any time operate within the corporate limits of the city or within one-half (½) mile thereof any public address system without first obtaining a permit as required in section 37-16 of this Code.

    (2)

    Nothing herein stated shall in any way affect the use of public address systems for emergency purposes.

    (3)

    The provisions of this section do not apply to any public or parochial school sanctioned activity.

    (c)

    Penalty. Violation of this section is punishable under section 1-20 of this Code.
