§ 37-16. Permits for public address systems.
Any person requesting permission to use a public address system as required in section 45-706 of this Code shall submit his or her request for use of a public address system to the city clerk, which said request shall state the specific location of the use, the date and time of the use, the purpose of the use, and such other information as the city clerk may request. All requests shall be filed with the city clerk at least fourteen (14) days prior to the requested time of use. The city clerk shall refer the request for use to the public works director or such other person as the city administrator may designate. After consultation with the chief of police and the fire chief, the permit for use of a public address system may be granted by the public works director or such other person as the city administrator may designate if it is determined that the use does not endanger public safety, health, or welfare or create excessive noise. It is provided, however, that no permit for use of a public address system shall be issued for use between the hours of 12:00 midnight and 8:00 am. If the permit for use of a public address system is denied, then the city clerk shall notify the requesting party stating the reasons for the denial. If the permit for use of a public address system is granted, then the city clerk shall forward the permit for use of a public address system to the requesting party and the permit shall set forth the date, time, place, and limitations or restrictions of the use of the public address system.
