§ 53-26. Court costs—Generally.

  • (a)

    Court costs. In addition to any fine that may be imposed by the municipal judge, there shall be assessed as costs in all cases the following amounts:

    (1)

    Costs of court in the amount of twelve dollars ($12.00);

    (2)

    Issuance of warrants costs twenty-seven dollars ($27.00);

    (3)

    Actual costs assessed against the city by the county sheriff for apprehension or confinement in the county jail;

    (4)

    Mileage, in the same amount as provided to the sheriff in criminal violations, for each mile and fraction thereof the officer must travel (both directions) in order to serve any warrant or commitment or order of this court;

    (5)

    In all cases where there is a finding of guilty or conviction for a violation of an alcohol-related offense as established by this court, the court may assess an amount in additional costs, up to the maximum amount of fifty-two dollars ($52.00), to defray the expenses of the city incurred in enforcing these sections. Both the city and the defendant shall have the right to present evidence to the court before the amount of the assessment is determined.

    (b)

    Additional court costs and surcharges. In addition to any fine that may be imposed by the municipal court, there shall be additional court costs assessed in the following amounts and for the offenses and circumstances as set forth hereinafter:

    (1)

    Training of law enforcement officers.

    a.

    The municipal judge shall assess as court costs the sum of three dollars ($3.00) for each violation of the ordinances of the city, provided that no such fee shall be collected in any proceeding when the proceeding or the defendant has been dismissed by the court, or when the defendant is found to be indigent.

    b.

    Two dollars ($2.00) of such fee collected shall be transmitted monthly to the treasurer of the city, to be used locally for training law enforcement officers. One dollar ($1.00) of such fee collected shall be deposited in the peace officer standards and training commission fund, to be used state wide for training law enforcement officers. The checks transmitting such funds shall be made payable by the clerk to the "Treasurer, State of Missouri," and shall be mailed on or before the fifteenth (15th) day of each month to Budget Director, Department of Public Safety, P.O. Box 749, Jefferson City, Missouri, 65102.

    (2)

    Crime victims compensation fund.

    a

    In all cases in which the proceeding or the defendant has been dismissed by the court, or when costs are to be paid by the city on behalf of an indigent defendant, an additional amount of seven dollars and fifty cents ($7.50) surcharge shall be assessed for the crime victims compensation fund.

    b.

    Seven and thirteen one-hundredths (7.13) percent of the surcharge assessed under this subsection by the municipal court clerk shall be remitted to the director of revenue monthly and the balance deposited in the city's general revenue fund.

    (3)

    Motorcycle safety trust fund.

    a.

    There shall be additional court costs assessed for any person who violates a municipal ordinance as an operator of a motorcycle or motor-tricycle in the amount of five dollars ($5.00).

    b.

    There shall be additional court costs in the amount of five dollars ($5.00) assessed on any motor vehicle operator who violates a municipal ordinance where a violation involves a motorcycle or motor-tricycle or whether the operator causes an accident involving a motorcycle or motor-tricycle.

    c.

    Court costs assessed under this subsection shall be doubled if the operator at fault violated any local ordinance relating to consumption of alcohol

    d

    Court costs under this subsection by the municipal court clerk shall be paid into the sate treasury to the credit of the motorcycle safety trust fund created by section 302.137 RSMo. 1994.

    (4)

    Domestic violence shelter fund.

    a.

    In all cases an amount of four dollars ($4.00) additional court costs shall be assessed for purposes of the domestic violence shelter fund (RSMo 488.607).

    b.

    The court shall not assess the costs specified in this sub-section in any case when the proceeding has been dismissed by the city or when costs are paid by the city on behalf of an indigent defendant.

    c.

    Costs collected for the aforesaid fund shall be collected by the clerk and dispersed to the county clerk at least monthly.

    (5)

    Spinal cord injury fund.

    a.

    There shall be additional court costs assessed for any person convicted of an intoxication-related offense under section 10.12.090 of this Code in the amount of twenty-five dollars ($25.00).

    b.

    The court shall not assess the costs specified in this sub-section in any case when the proceeding has been dismissed by city or when costs are paid by the city on behalf of an indigent defendant.

    c.

    Costs collected under this section shall be remitted to Missouri Department of Revenue, County Tax Section, Spinal Cord Injury Fund, P.O. Box 453, Jefferson City, Missouri 65105-0453.

    (6)

    Inmate security fund.

    a.

    In all cases an amount of two dollars ($2.00) additional court costs shall be assessed for purposes of the inmate security fund. (Section 488.5026, RSMo).

    b.

    The court shall not assess the costs specified in this subsection in any case when the proceeding has been dismissed by the city or when costs are paid by the city on behalf of an indigent defendant.

    c.

    The city treasurer shall deposit funds generated into the inmate security fund. Funds deposited shall be utilized to develop biometric verification systems to ensure that inmates can be properly identified and tracked within the local jail system. Upon the installation of the biometric verification system, funds in the inmate security fund may be used for the maintenance of the biometric verification system and to pay for any expenses related to custody and housing and other expenses for prisoners.

    (7)

    Sheriffs' retirement fund.

    a.

    In all cases an amount of three dollars ($3.00) additional court costs shall be assessed for purposes of the Sheriffs' Retirement Fund (RSMo 57.955.1).

    b.

    The court shall not assess the costs specified in this subsection in any case when the proceeding has been dismissed by the city or when costs are paid by the city on behalf of an indigent defendant.

    c.

    The city treasurer shall deposit the funds generated into the sheriffs' retirement fund. Funds shall be used only for the purposes provided in RSMo 57.949 to 57.997, and for no other purpose.
