§ 29-27. Collection of solid waste.

  • (a)

    The city shall provide for the collection from all residential single-family dwelling units, duplexes or condominiums of all solid wastes in the city, provided, however, that the city may provide the collection service by contracting with a person, county, or other city or a combination thereof, for the entire city or portions thereof, as deemed to be in the best interests of the city.

    (b)

    The collection of solid waste, including but not limited to waste of commercial establishments, the waste of any facility licensed under this Code or the State of Missouri for any purpose, and the collection of solid waste not provided for in subsection (a) shall be provided by private commercial trash hauler.

    (c)

    All solid waste collected shall, upon being loaded into transportation equipment, become the property of the solid waste collector.

    (d)

    Disposable solid waste containers as required by this chapter for the storage of residential solid waste shall be placed at the curb for collection after 6:00 p.m. on the day next preceding the regularly scheduled collection and before 8:00 a.m. on the regularly scheduled collection day. Residents shall be responsible for litter and/or trash upon the tearing, rupture, or breakage of the disposable solid waste containers.

    (e)

    Special bulk pickup may be arranged by contacting the public works department.

    (f)

    Solid waste collectors, employed by solid waste collection agency operating under contract with the city, are hereby authorized to enter upon private property for the purpose of collecting solid waste therefrom as required by this chapter. Solid waste collectors shall not enter dwelling units or other residential buildings for the purpose of collecting residential solid waste.

    (g)

    The following collection frequencies, container limitations and charges shall apply to collections of solid waste within the city:

    (1)

    All residential solid waste shall be collected at least once weekly and up to three (3) disposable solid waste containers per week shall be collected. The city shall charge all residential customers as set forth in subsection (a) of this section the sum of six dollars ($6.00) per month beginning January 1, 2015. Each additional disposable solid waste container beyond three (3) containers per week shall display an official sticker to be purchased from the city at one dollar ($1.00) per sticker. Containers beyond three (3) per week will not be collected unless said sticker is prominently displayed. The board of aldermen may from time to time adjust the solid waste fees set forth in this section without amending this code of ordinances. A schedule of solid waste fees currently in effect shall be kept on file in the office of the city clerk of the city and made available for inspection by the public.

    (2)

    All residential compostables, yard waste and tree limbs shall be collected at least twice monthly and shall be collected at such lesser intervals as may be fixed by the director upon a determination that such lesser intervals are necessary for the preservation of the health and/or safety of the public.

    (3)

    Collection of all residential bulky rubbish and major appliances may be arranged by contacting the public works department, provided the resident has paid, or has arranged to pay, for the applicable charges.

    (4)

    All commercial solid waste shall be collected at least once weekly by a private commercial hauler at the cost to the customer and shall be collected at such lesser intervals as may be fixed by the director upon a determination that such lesser intervals are necessary for the preservation of the health and/or safety of the public.

    (h)

    It shall be unlawful for any person, firm or corporation collecting and disposing of rubbish, garbage or waste material from premises in the residential zoning districts to make such collection or dispose of rubbish, garbage or waste materials between the hours of 9:00 p.m. and 6:00 a.m. Failure to comply with the provisions herein stated shall constitute a misdemeanor and subject the offender to the penalties prescribed for violation of this Code.
