§ 11-22. Records required; fee schedule.

  • (a)

    A careful record of all such applications, plans and permits as required hereby and as required by the building, electrical, mechanical, plumbing and storm water codes and regulations shall be kept in the office of the building official.

    (b)

    Fees to be charged for building permits, plumbing permits, electrical permits, mechanical permits, appliance permits and storm water permits shall be as follows:

    (1)

    Building permit. The fee for a building permit shall be as follows:

    a.

    Residential building permit fee for new construction including building additions shall be based on the cumulative square foot construction costs (sfcc) listed below:

    Main floor: ..... $85.00/sq. ft.

    Finished basement: ..... $35.00/sq. ft.

    Unfinished basement: ..... $15.00/sq. ft.

    2nd floor/habitable space above 2nd floor: ..... $35.00/sq. ft.

    Garage: ..... $30.00/sq. ft.

    Porch/Deck/Carport: ..... $15.00/sq. ft.

    The permit fee shall also be based on the gross building area (gba) as set forth in plans submitted by the applicant. The residential building permit fee shall be multiplied as: sfcc × gba × .0010. The minimum residential building permit fee shall be twenty dollars ($20.00).

    b.

    Commercial building permit fee for new construction including building additions shall be based on the square foot construction cost (sfcc) as published in the most recent edition of the International Code Council Building Valuation Data Square Foot Construction Costs and guidelines for use currently on file with the city clerk. It shall also be based on the gross building area (gba) as set forth in the plans submitted by applicant. Therefore, commercial building permit fee = sfcc X gba X .0003. The minimum commercial building permit fee shall be twenty dollars ($20.00).

    c.

    The fee for a building permit for remodeling projects, pools, residential storage sheds, decks, carports, and driveways, excluding additions, shall be twenty dollars ($20.00) for the first five thousand dollars ($5,000.00) of building costs, one dollar ($1.00) per one thousand dollars ($1,000.00) of building costs after five thousand dollars ($5,000.00) and a minimum building permit fee of twenty dollars ($20.00).

    (2)

    Plumbing permit. The fee for a plumbing permit shall be twenty dollars ($20.00) per building.

    (3)

    Electrical permit. The fee for an electrical permit shall be twenty dollars ($20.00) per building.

    (4)

    Mechanical permit. The fee for a mechanical permit shall be twenty dollars ($20.00) per building.

    (5)

    Appliance permit. Subsection 11-22(b)(5) of the Code of Ordinances of the City of Jackson, Missouri is hereby deleted.

    (6)

    Storm water permit. In addition to the payment of fees for storm water maintenance as provided in this chapter, the fee for a storm water control permit shall be twenty-five dollars ($25.00) per building permit issued. This fee shall be used to defray the city's cost of storm water control permit review. However, individual permits issued for the construction of a driveway, patio, sidewalk or an accessory building no larger than two hundred (200) square feet in floor area or for the construction of a fence shall be exempt from paying the storm water permit fee.

    (c)

    Inspection/reinspection fees shall be charged to all holders of building permits in accordance with the fee schedule hereinafter established, which such charges shall be paid before the issuance of occupancy permits.

    (1)

    Inspections. For all inspections required under city building code, there is hereby established the following fee schedule:

    Scheduled inspection ..... $0.00

    (2)

    Reinspections. In the event it becomes necessary for a city building inspector to reinspect a job required to be inspected under the city building codes, the holder of the building permit shall pay a reinspection fee based on the following fee schedule:

    First reinspection ..... $  0.00

    Second reinspection ..... 50.00

    Third reinspection ..... 100.00

    Each additional reinspection shall be at a rate of one hundred dollars ($100.00) per reinspection.

    (d)

    Review of applications and plans for commercial and industrial buildings or additions; fees deposit. All estimated permit fees for commercial and industrial buildings and additions shall be paid at the time of submission of the owner's application. In the event the application is abandoned, or permits are not issued therefor, the estimated permit fees shall be forfeited to help cover city's cost of review. If permits are issued, the prepaid estimated permit fees shall be applied to the final permit fee.

    (e)

    In order to provide a system to assure that permits, inspections and licenses are obtained prior to the beginning of a project, the following provisions are hereby established:

    (1)

    In the event of noncompliance with any portion of this section, then the building and planning superintendent or such other person as the city administrator designates may, in his or her absolute discretion, require the removal of so much of the work as is necessary to assure compliance with this Code or may accept certification under seal from an engineer licensed in the State of Missouri that all codes have been complied with.

    (2)

    Any contractor doing any work within the city without required licenses or inspections shall pay as a fine:

    a.

    For the first violation the sum of fifty dollars ($50.00).

    b.

    For a second violation within twenty-four (24) months of a previous violation the sum of one hundred dollars ($100.00).

    c.

    For a third violation within twenty-four (24) months of a previous violation the sum of two hundred fifty dollars ($250.00) plus the loss of the business license and suspension from doing business within the city for one (1) calendar year.

    A violation is defined as all deficiencies from any one (1) inspection and the city shall not stack multiple deficiencies from one (1) inspection so as to constitute multiple penalties.

    (3)

    Prior to any project which was commenced without the permits and inspections required in this section being allowed to resume, the contractor or, if the project was done without a contractor, the property owner shall obtain all required permits and inspections and shall pay as penalty, in addition to other charges herein, an amount twice the amount of the charge for the permits as a penalty for noncompliance with this section.

    (4)

    All penalties set forth in this section shall be in addition to any fines or incarceration applicable under section 11-24 of this Code.

    (5)

    Any person aggrieved by the application of this subsection 11-22(e) of this Code may appeal to the board of appeals within thirty (30) days of any notification of violation and no further work on the project may be done until the conclusion of the appeal process. The standard of review applied at an appeal shall be that the appellant has the burden of proving that the violations were a result of reasonable mistakes by the appellant. The defense that the appellant believed some other party had obtained the required permits or inspections shall not constitute reasonable mistakes.
